A startup backed by prominent figures from Yahoo and Intel has filed a lawsuit against tech giants Nvidia and Microsoft, accusing them of patent infringement and collusion to fix prices in the AI chip market. Xockets, based in Texas, claims that Nvidia has violated its patented data processing unit (DPU) technology, which is crucial for enhancing efficiency in cloud infrastructure by speeding up data-heavy tasks. The lawsuit also alleges that Microsoft, as an Nvidia customer, has been granted special access to Nvidia’s infringing GPU-based server systems and AI components.
Xockets specifically points fingers at Nvidia’s DPUs, including BlueField, ConnectX, and NVLink Switch, as being built on Xockets’ patented technology. The startup asserts that it brought the issue to Nvidia’s attention in February 2022, but the chip giant has been engaging in “efficient infringement” – essentially choosing to infringe first and deal with the legal consequences later. Moreover, Xockets accuses Nvidia of monopolizing the market for GPU servers for AI and collaborating with Microsoft in a buying cartel facilitated by an organization named RPX.
The lawsuit alleges that RPX, acting at the behest of major tech companies, including Nvidia and Microsoft, orchestrated buyers’ cartels to collectively suppress innovation such as Xockets’, driving prices to artificially low levels. Through this alleged cartel, Microsoft and Nvidia purportedly dominate the GPU-enabled generative AI sector by controlling the necessary equipment and platforms. Xockets aims to hold both companies accountable for patent infringement and antitrust violations, seeking financial damages and an injunction against further patent violations and anticompetitive practices.
Despite facing off against two tech behemoths, Xockets investor and board member Robert Cote remains confident in the startup’s ability to take on the challenge. An experienced IP lawyer himself, Cote believes that Xockets possesses the resources and determination necessary to stand up to Nvidia and Microsoft in court. The startup’s founder and board member, Parin Dalal, who also works as a principal engineer at Google, has played a pivotal role in raising awareness about the alleged infringement, although Google itself does not appear to be directly involved in the legal dispute.
As the legal battle unfolds, the outcome could have significant implications for the AI chip industry and the broader tech landscape. The case raises questions about intellectual property rights, antitrust practices, and the power dynamics at play among tech giants. Whether Xockets will succeed in proving its claims against Nvidia and Microsoft, or if the tech titans will emerge victorious, remains to be seen. Nonetheless, this showdown underscores the fierce competition and high stakes in the rapidly evolving field of AI chip innovation.
